- Partnership Deed and PAN Card of firm (for partnership firms).
- Certificate of Incorporation, MoA/AoA, and PAN Card (for Pvt Ltd / LLP).
- Udyam / MSME Certificate (for small businesses — reduced government fees).
- Signed Form TM-48 / Form 48 (Power of Attorney) by the applicant.
- User Affidavit (if claiming prior use of the mark).
- Description of goods or services for which the mark is to be used.
Trademark Registration Process
- Trademark search to check availability and assess registrability on the IP India portal.
- Identify the correct trademark class(es) for your goods/services (Classes 1–34 for goods, 35–45 for services).
- File trademark application (Form TM-A) with the Trademark Registry along with all required documents.
- Examination by the Trademark Office — respond to any objections raised within 30 days.
- Publication in the Trademark Journal for 4 months — third parties may file opposition during this period.
- Registration and issuance of Trademark Certificate if no opposition or opposition decided in your favour.
Trademark Classes
- Trademarks are registered under 45 classes — Classes 1–34 for goods, Classes 35–45 for services.
- You must file under the class(es) relevant to your business.
- Filing under multiple classes requires separate applications and fees per class.
